No 164/2008 Federal Court conviction for arson attack on Turkish club in Esslingen
of a judgment 22nd February 2008, the Stuttgart Regional Court sentenced four defendants for attempted arson in coincidence with verbotswidrigem manufacture and use of incendiary and property damage. Against three defendants have prison sentences of two years and six months, imposed upon a defendant a youth sentence of two years. One of the defendants had been previously convicted of attempted murder among other things, to a seven-year sentence because he in another arson attack on an occupied detached House in Göppingen was also involved. The district court Stuttgart for this defendant - in answer to a total imprisonment of eight years for both actions - later.
According to the findings of the youth panel three of the accused Kurdish origin, while the fourth, as a Turkish citizen with the PKK and its fight for an independent Kurdistan sympathizes. After the four defendants on 1 March 2007, the media of an alleged poisoning of the Kurdish leader Ocalan had heard they wanted to put an effective media spectacular sign of resistance against the oppression of the Kurds. In the following night, they committed means of three petrol bombs set fire to the building of a Turkish national force "Turkish Workers Association eV" in Esslingen. They assumed that staying in the building, not people. Actually spent the night there in the night of the crime in guest rooms, four people who were not harmed, however. The fire, which did not enter into the interior, was extinguished by itself. It was mostly just to fouling.
against the decision two of the defendants have filed an appeal and that in each case based on the violation of procedural and substantive law. The 1 Criminal Division of the Federal Court has by order dated 26th August 2008, the revision as manifestly unfounded discarded. The ruling by the district court is final for all defendants.
